1. Adult Platform Notice

PeachBunni is an adult-oriented content discovery, aggregation, and community platform for users 18 and older.

Nature of Content:

• Native Content: User-uploaded photos hosted on PeachBunni are restricted to suggestive/non-explicit imagery.
• Embedded Content: This platform embeds third-party video content that contains sexually explicit conduct.

By using this Service, you acknowledge and agree that:

• You are at least 18 years old.
• You consent to viewing sexually explicit material embedded from third-party sources.
• You will not permit minors to access this Service.

2. Eligibility and Age Verification

You must be at least 18 years of age (or the age of majority in your jurisdiction, whichever is greater) to access or use PeachBunni.

By using this Service, you represent and warrant that:

• You are at least 18 years old.

• You are not prohibited by law from accessing adult content.
• All registration information you provide is accurate and complete.

We employ reasonable measures to prevent minors from accessing the Service, including age-gating mechanisms and access controls. However, you acknowledge that no system is foolproof, and you agree not to circumvent our age-gating measures.

3. Geographic Restrictions

Access to PeachBunni is blocked from the following US states: Alabama, Arizona, Arkansas, Florida, Georgia, Idaho, Indiana, Kansas, Kentucky, Louisiana, Mississippi, Missouri, Montana, Nebraska, North Carolina, North Dakota, Ohio, Oklahoma, South Carolina, South Dakota, Tennessee, Texas, Utah, Virginia, and Wyoming.

By using this Service, you represent and warrant that:

• You are not located in, and will not access the Service from, any restricted state.
• You will not use VPNs, proxies, or other means to circumvent geographic restrictions.
• You understand that circumventing these restrictions violates these Terms.

Consequences of Circumvention:

• Immediate account termination without warning.
• No refund of any paid features or subscriptions.
• Permanent ban from the Service.
• Possible legal action if we suffer damages.

Access restrictions are implemented in response to state-level age verification laws and are enforced using reasonable technical measures such as IP-based location detection. We reserve the right to expand or modify restricted regions at any time as laws change. We may provide notice of such changes when practicable.

4. Your Account

Account Registration:

• You must provide accurate and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are fully responsible for all activities that occur under your account.

Account Termination:

• You may delete your account at any time through account settings.
• We reserve the right to suspend or terminate your account at our sole discretion.

5. Content Policy - Acceptable Use and Prohibited Content

PeachBunni operates on a Hybrid Content Model. Different rules apply to content you upload (Native) versus content linked from other sites (Embedded).

A. Native Uploads

Applies to photos you upload directly to our servers. Video uploads are not permitted.

Allowed (Native):

• Suggestive photography (lingerie, teasing poses).
• Implied nudity (covered bits, artistic framing).
• Topless images (where legally permissible).
• Body-positive content.

Strictly prohibited (Native):

• Hardcore sexual acts: penetration, oral sex, masturbation, or ejaculation.
• Explicit genitalia: close-ups of exposed genitals or spreading.
• Illegal content: CSAM, non-consensual content, violence.

B. Embedded Content

Applies to videos embedded via links from approved platforms (e.g., Pornhub, RedGifs).

Allowed (Embeds):

• Sexually explicit content and hardcore acts are permitted only if embedded from approved third-party platforms.
• PeachBunni does not host these files.

Curation and Aggregation Role: Embedded video content displayed on PeachBunni is embedded from approved third-party platforms and may be organized and displayed for purposes of discovery, categorization, and recommendation. Embedded videos are provided through the Service's discovery features and are not uploaded to PeachBunni by users. PeachBunni does not create, produce, direct, edit, or host such content. All embedded content remains hosted on, and under the control of, the originating third-party platform and may be removed or changed by that platform at any time. We may remove, disable, or restrict access to embedded content at any time in our sole discretion. The list of approved platforms may be updated at any time in our sole discretion.

C. Strictly Prohibited Content (All Content Types)

• Child Sexual Abuse Material (CSAM): Zero tolerance; reported to NCMEC.
• Non-consensual content: Revenge porn, hidden cameras.
• Violence/Gore: Bestiality, necrophilia, self-harm, snuff content.
• Privacy Violations: Doxxing or sharing private info without consent.

Automated Moderation: We use automated content moderation tools (e.g., Sightengine) to proactively block images that violate our content guidelines at upload time.

6. Your Content and Responsibilities

Content Ownership: You retain ownership of content you post ("User Content"). By posting, you grant PeachBunni a worldwide, non-exclusive, royalty-free license to use, display, reproduce, and distribute your content as necessary to operate the Service.

Your Representations and Warranties: By uploading any content to PeachBunni, you explicitly represent, warrant, and confirm that:

• You are 18 years or older.
• All people depicted in your content are 18 years or older.
• All people depicted have provided explicit consent.
• You have all necessary rights to upload the content.
• The content does not violate these Terms or any laws.

Content Attestation: Every time you upload content, you will be required to confirm your understanding and agreement with these representations. This attestation is legally binding.

7. Copyright and DMCA Compliance

PeachBunni respects intellectual property rights and complies with the Digital Millennium Copyright Act (DMCA).

Filing a DMCA Takedown Notice: If you believe that content on PeachBunni infringes your copyright, you may submit a takedown notice to our designated DMCA agent. Your notice must include:

1. Your physical or electronic signature.
2. Identification of the copyrighted work.
3. Identification of the infringing material (URLs).
4. Your contact information.
5. A statement of good faith belief that the use is not authorized.
6. A statement, under penalty of perjury, that the information is accurate.

8. Community Moderation and Enforcement

Reporting Tools: You can report posts, users, and groups that violate these Terms using our in-app reporting tools.

Strike System: We enforce a progressive strike system (Warning -> Suspension -> Ban).

Immediate Termination: We reserve the right to ban users immediately for severe violations (CSAM, Spam, Botting).

9. Premium Features and Supporter Tiers

Third-Party Billing: PeachBunni may offer optional "Supporter" memberships or tiers. These transactions are processed entirely by third-party platforms (e.g., Fansly). PeachBunni does not process payments directly or store credit card information.

Scope of Purchase: Supporter memberships are optional subscriptions processed by third-party platforms. They may include access to non-content features (e.g., badges, analytics, privacy tools). Memberships do NOT purchase access to content. All content on PeachBunni remains free to view.

Billing Terms:

• Subscriptions are billed by the third-party processor.
• Cancellation and refunds are subject to the third-party processor's policies.

10. Privacy and Data Protection

Data Collection: We collect and process personal information as described in our Privacy Policy.

Your Responsibilities: Do not post others' private information without consent.

11. Intellectual Property

PeachBunni Ownership: All non-User Content (features, design, logos) is owned by PeachBunni.

Limited License: We grant you a limited, revocable license to use the Service for personal, non-commercial purposes.

12. Third-Party Links and Services

The Service contains links to third-party websites. We do not endorse or control these third parties and are not responsible for their content.

13. Disclaimers and Limitation of Liability

SERVICE PROVIDED "AS IS". PEACHBUNNI IS PROVIDED WITHOUT WARRANTIES OF ANY KIND.

Section 230 (User Content Only): To the extent applicable, PeachBunni relies on the protections of 47 U.S.C. Section 230 solely with respect to user-generated native content uploaded by users. This protection is relied upon only for user-generated native content. Embedded content is provided via third-party platforms and is governed by those platforms' terms and policies.

LIMITATION OF LIABILITY: TO THE MAXIMUM EXTENT PERMITTED BY LAW, PEACHBUNNI SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED $100 USD.

14. Indemnification

You agree to indemnify and hold harmless PeachBunni from any claims arising out of your use of the Service, your User Content, or your violation of these Terms.

15. Governing Law and Dispute Resolution

Governing Law: New York State Law.

Venue: Nassau County, New York.

Mandatory Arbitration: Any dispute shall be settled by binding individual arbitration (AAA).

Class Action Waiver: You waive any right to a jury trial or class action participation.

16. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or site notice. Your continued use constitutes acceptance.

17. General Provisions

Entire Agreement: These Terms + Privacy Policy constitute the entire agreement.

Severability: If any part is invalid, the rest remains in effect.

18. Account Termination

We may terminate your account for any violation of these Terms. No refunds will be issued for terminated accounts.

20. Community Contests and Leaderboards

PeachBunni provides features for community engagement through "Contests" or "Leaderboards." By participating, you agree to the following rules:

A. Non-Monetary Nature (No Cash Prizes / No Entry Fee)

• No Gambling: Contests on PeachBunni are strictly for community engagement. There is NO cost to enter and NO cash prizes.
• Rewards: Rewards are limited to digital, non-monetary items within the Service, such as "Profile Badges," "Titles," or placement on a visible "Leaderboard." These rewards have no real-world cash value and cannot be exchanged for currency.

B. Voting and Ranking Mechanism

• User-Driven Ranking: Winners are determined solely by the Average User Ratings submitted by the community.
• No Editorial Control: The Administrator's role is strictly limited to technical maintenance and setting the generic Contest Title/Description. We do not hand-pick winners or judge entries.
• Fair Play: You acknowledge that ranking is dynamic and based on subjective user opinions. PeachBunni is not liable for "review bombing," low ratings, or fluctuations in your leaderboard position.

C. Content Requirements

• Strict Adherence to Section 5: All contest entries are "Native Uploads" and must strictly adhere to Section 5A of these Terms.
• Prohibited Content: You may NOT upload hardcore sexual acts, explicit genitalia, or illegal content to enter a contest. Any user attempting to win by uploading prohibited explicit content will be immediately disqualified and banned.

D. Integrity and Disqualification

• We reserve the right to disqualify any participant who attempts to manipulate the voting system (e.g., using bots, scripts, or fake accounts).
• We reserve the right to cancel or suspend a Contest if technical issues or fraud compromise the integrity of the voting process.

E. No Producer Relationship (2257 Compliance)

For the purposes of 18 U.S.C. Section 2257 and applicable law, you acknowledge that:

• User is Sole Producer: You are the sole producer of your content. You retain full control over the creation, setting, attire, lighting, and production of your entry.
• No Directorial Control: The Contest Title (e.g., "Summer Vibes") acts solely as a categorization tag or prompt. Contests are optional prompts and do not request, require, or encourage sexually explicit conduct. It does not constitute a specific directorial command or instruction from PeachBunni. We do not direct you on how to create the content.
• No Employment: Participation in a contest does not create an employment, contractor, or agency relationship between you and PeachBunni. You are not being compensated for the creation of the content.

21. Acknowledgment and Acceptance

1. You have read, understood, and agree to be bound by these Terms of Service.
2. You meet all eligibility requirements, including being at least 18 years of age.
3. You are not located in, and will not access the Service from, a restricted US state.
4. You understand PeachBunni is an adult platform with a hybrid content model (non-explicit native uploads; explicit embeds from third parties).
5. You consent to viewing sexually explicit material embedded from third-party sources.
6. You accept full responsibility for all content you upload.
7. You agree to mandatory arbitration and waive class-action rights.
8. You accept all disclaimers and limitations of liability.
9. You agree to indemnify PeachBunni as described in these Terms.
10. You understand violations may result in account termination, legal consequences, and criminal liability.
11. You have read and agree to our Privacy Policy and Community Guidelines.

IF YOU DO NOT AGREE TO THESE TERMS IN THEIR ENTIRETY, YOU MAY NOT ACCESS OR USE PEACHBUNNI.
