Who May Submit a DMCA Notice

Only the copyright owner or an authorized agent acting on behalf of the copyright owner may submit a valid DMCA takedown notice. Submitting false or fraudulent claims may result in account termination and legal liability under 17 U.S.C. §512(f).

DMCA Takedown Requirements

A valid DMCA takedown notice must include the following:

• Identification of the copyrighted work claimed to have been infringed
• URL(s) of the allegedly infringing material on PeachBunni
• Full legal name of the complaining party (copyright owner or authorized agent)
• Mailing address
• Email address
• A statement that the complaining party has a good faith belief that use of the material is not authorized by the copyright owner, its agent, or the law
• A statement, under penalty of perjury, that the information in the notice is accurate and that the complaining party is authorized to act on behalf of the copyright owner
• Electronic signature (typed full legal name)

We will review valid notices promptly and take appropriate action as required by law.

Counter-Notification

If you believe your content was removed in error or misidentification, you may submit a counter-notification. A valid counter-notification must include:

• Your full legal name, mailing address, and contact information
• Identification of the material that was removed and its location prior to removal
• A statement under penalty of perjury that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification
• A statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located, or if outside the United States, the United States District Court for the Eastern District of New York, and that you will accept service of process from the person who provided the original DMCA notice or an agent of such person
• Your electronic signature (typed full legal name)
